Responsible declaration: declaración responsable
By Ross Alinari · Last checked · Editorial policy · How we check facts
What a declaración responsable establishes, which documents support it and why the submitted renovation scope matters under the Valencian planning rules.
A formal declaration that the applicable requirements are met, accompanied by the required documents. For relevant Valencian works, TRLOTUP article 241 governs the submission and its effects.
What the declaration establishes
The declaration is a responsible statement about compliance, not a general waiver of building rules. Article 241 connects its effect to presenting the statement and required documents to the competent local authority. Municipal checking and inspection remain possible, and essential inaccuracies or omissions can prevent starting or continuing the works.
The file must describe the actual intervention. A broad label such as kitchen refurbishment may conceal a structural alteration or an external service route that changes the assessment. Ask the technician to identify the relevant article 233 category before selecting the municipal form.
Documents to keep together
Article 241 identifies the promoter and building agents, the graphic and written description, the location and a technical project where required. It also addresses environmental documentation where applicable, intended timing, debris and public-road use. Keep the submitted revision with the receipt so it is clear what was filed.
An owner abroad should arrange for municipal communications to be read and referred to the right person. A receipt proves submission of a package; it does not replace the underlying compliance assessment or any separate permission.
When the proposal changes
Compare a requested variation with the filed scope before instructing construction. A different opening or service route can require another technical or procedural assessment. Keep the answer and any revised documents in the same property file.
For a fuller explanation of categories, supporting documents and remote coordination, read the responsible declaration guide. Its examples illustrate decision-making and do not establish permission for a particular property.
An owner's example
A flat owner compares the final drawings with the documents to be submitted, ensuring a revised drainage layout is included before signing.
